PRIVACY POLICY FOR CANDIDATES

Introduction

We respect your privacy and are committed to protecting it through our compliance with this Candidate Privacy Policy. This Candidate Privacy Policy describes the types of information we may collect from Candidates (as defined in our Candidate Terms of Service) or that Candidates may provide when they visit the website www.amazetal.com (our “Website”), and our practices for using, maintaining, protecting and disclosing that information.

This Candidate Privacy Policy applies to any information that we collect on the Website from Candidates, including any information in any e-mails, posts, texts and other electronic messages between Candidates and the Website and any information about Candidates transferred to the Website from other websites. This Candidate Privacy Policy does not apply to any information that we collect by any other means, including offline collection.

Please Note: If you are accessing the Website as an Expert or an Employer (as defined in our Candidate Terms of Service), please refer to our Expert Privacy Policy (www.amazetal.com/expert-privacy) or our Employer Privacy Policy (www.amazetal.com/employer-privacy), as applicable, for the policies that apply to you. If you are a Candidate (hereinafter, “you”), then this Candidate Privacy Policy applies to you.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you can choose not to use our Website. By accessing or using our Website, you agree to this privacy Policy. This Policy may change from time to time. Your continued use of the Website after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

What Information is Considered “Personal Information”?

Information we collect on our Website falls into one of two categories:

  1. Information by which you may be personally identified, such as first and last name; specific home, physical, or mailing address; e-mail address, username or “screen” name; telephone number, including a mobile telephone number; and any other information collected that is combined with one or more of the categories of information listed here.

  2. Other information that is about you but does not identify you personally, such as de-identified information about users’ education or work experience, or statistical traffic information about which buttons or links users click on most frequently when they access our Website.

For the purposes of this Privacy Policy, information listed in the first category above is considered to be your “Personal Information.” All other information that does not identify you individually or that is “anonymized” or “de-identified” is not considered Personal Information.

Information We Collect About You and How We Collect It

Direct Collection

The principal way we receive Personal Information about you is when you choose to provide it to us directly by filling out registration forms, creating a personal profile, and/or interacting with certain tools available to you via the Website.

At Registration. When you first register for the Website and fill out our registration form, we collect several types of information from you, including: your first and last name; contact information such as your e-mail address; a web address for your personal webpage or social media pages (if any); demographic information such as your gender and generalized geographic location (city and state); your immigration status; information about your credentials, including education, work experience and volunteering activity; information about your job requirements such as current salary, expected salary, job preferences, willingness to relocate, etc.; and (as an option) a photo of yourself for your profile.

If You Participate in Spotlight. Spotlight is an additional feature of the Website where Candidates, if they choose to participate, will engage in additional vetting and evaluation procedures. The program involves:

  • Answering a set of skill-based test questions, under close monitoring (video recording of the Candidate taking the test, live view of the Candidate’s computer screen while Candidate is taking the test, and/or live proctoring of the Candidate’s test via video-conference) to ensure there is no cheating;

  • The Candidate’s creation of a short self-promotion “pitch” video that will be shared with Experts and potential Employers; and

  • A review and evaluation of the Candidate’s total application (including “pitch” video and test scores) by one or more Experts via the Website.

By participating in this Spotlight program, in addition to the information collected at registration, we may collect through the Website additional information about the Candidate’s technical skills proficiency, education, and work experience.

If You Purchase Career Advice Consulting Sessions. Through the Website, you may elect to purchase one-on-one consulting services from Experts. If you choose to purchase any consulting services, we will collect certain payment information from you in order to process your payment, such as credit card information.

User Contributions. You also may provide information to be posted, published or displayed on public areas of the Website (such as your personal professional profile), including information about yourself, feedback on interactions with Experts, and other comments (collectively, “User Contributions”). Your User Contributions, including any Personal Information you include within your User Contributions, are posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Automatic Collection

When you access, use and navigate through the Website, the Website may use certain technologies (described below) to collect automatically the following information:

Traffic Data / Usage Details. When you access and use the Website, we may collect automatically certain details of your access to and use of the Website, including traffic data, logs, and other communication data, your navigation paths through the Website, the resources that you access and use on or through the Website and the referring and exit pages.

Computer and Device Information. When you access and use the Website, we may collect information about your computer or mobile device and your internet connection, including your IP address, operating system, browser type, the mobile device’s unique device identifier, mobile network information and the device’s telephone number.

If you do not want us to collect this information automatically your choice is to not access or use the Website and/or to not call into our phone lines.

We use the following technologies for automatic information collection:

Cookies (or mobile cookies). A cookie is a small file placed on your computer or mobile device. It may be possible to refuse to accept cookies by activating the appropriate setting on your browser or mobile device. However, if you select this setting you may be unable to access certain parts or features of the Website.

Web Beacons. Certain pages or portions of the Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related usage statistics (for example, recording the popularity of certain content and verifying system and server integrity).

Embedded Code. Certain pages or portions of the Website may use embedded hidden code to collect information about usage flows through the Website and other similar usage statistics.

Online Tracking and How We Respond to “Do Not Track” Signals

Tracking involves the use of cookies, web beacons or other embedded code or tracking technologies to collect, analyze and store information on a user’s behavior over time on multiple sites, including information on the sites visited, products viewed, products purchased and other online interactions. Tracking information can be used to enable companies to make interest-based (behavioral) advertising available to users on multiple sites that they visit.

We do not currently collect Personal Information about your on-line activities over time across third party sites for tracking purposes. We do not currently allow third parties to collect Personal Information on the Website that could be used by them to analyze and store information about your on-line activities over time and across third party sites for tracking purposes. Therefore, the Website does not and will not respond to any “DO NOT TRACK” signals sent by your browser or otherwise.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Information, to:

  • Provide you with the Website and its contents and any other information or services you request from us;

  • Calculate, through a proprietary algorithm, an overall Candidate score or rating that helps us to determine if you meet the minimum education and experience qualifications to participate as a Candidate on the Website;

  • Display your personal professional profile for Employers, Experts, and other users to see, which Employers and/or Experts may then use your information to contact you regarding interviews, assessments, and services offered;

  • If you choose to participate in the Spotlight program, evaluate and publish your proficiency in certain technical skills, submit your personal professional profile for Experts to review and evaluate, and to showcase your personal professional profile to Employers;

  • Connect you with Experts from whom you have elected to purchase Career Advice consulting services, and to bill you directly for such services;

  • Provide you with important e-mail communications from us, including information about transactions you carry out through the Website (e.g., registration confirmation) and information about educational or career development resources that may be of interest to you (for information about how you can opt out of receiving certain e-mails from us, see the section below titled “Choices About How We Use and Disclose Your Information”);

  • Share your User Contributions with other users at your direction;

  • Include your User Contributions in user ratings (e.g., ratings of Expert consulting services) for other users to see;

  • Fulfill any other purpose that we describe when you provide the information;

  • Fulfill any other purpose for which you provide it;

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including our Candidate Terms of Service (www.amazetal.com/candidate-terms);

  • Notify you when updates to the Website are available and of any changes to any services we offer or provide through it; and

  • Notify you when updates to this Candidate Privacy Policy occur.

The traffic data, usage details, and “persistent identifiers” we collect help us to improve the Website and to deliver a better and more personalized experience by enabling us to:

Estimate our audience size and usage patterns.

Learn to improve the “flow,” organization and user interface of the Website.

Recognize you when you use the Website and store information about your preferences, allowing us to customize the Website according to your individual interests.

Speed up your searches.

We use the feedback you provide in response to surveys you complete to improve the functionality of the Website and ensure our expectations for quality service are being met by our employees and other service providers you may interact with through the Website.

Use of Your Information for Promotional, Advertising and Marketing Purposes

Direct Marketing From Us. We may use your Personal Information (in particular, your e-mail address) to provide you with promotional information about our own products and services or to communicate to you directly certain information about educational or career development resources that may be of interest to you.

Third Party Marketing. If you choose to share your Personal Information with certain third parties on the Website—for example, if you choose to submit an application for an open position with an Employer or if you choose to hire an Expert for Career Advice consulting services—those third parties are provided with and permitted to use your Personal Information only to fulfill the purpose for which you provide it. Third parties are not provided with or permitted to use your Personal Information for any promotional, advertising or marketing purposes. We also do not display banner or pop-up advertisements on our Website.

Use of Your Anonymized Information for Data Analytics Purposes

We may collect and use anonymized or de-identified information (but not Personal Information) about our users to track certain employment and career development trends, and we may publish related statistics to our Website’s blog. For example, we may collect, analyze, and post information about which types of degrees held by our users (in general) are most likely to result in successful employment outcomes.

Disclosure of Your Information

We may disclose your information, including your Personal Information:

  • To other users, Experts, or Employers on the Website to the extent you choose to include it in your personal professional profile, in any applications you submit to any Employers, in any communications with Experts through the Website, or in User Contributions you post publicly, in each case as you direct us to do so via the Website’s forms and interactive features;

  • To our directors, officers, employees, subsidiaries, parent and affiliates;

  • To contractors, service providers and other third parties we use to support our business and help us operate, maintain and improve the Website and who (1) need to know such information to support our permitted uses of Personal Information in accordance with this Privacy Policy, and (2) are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them;

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by the us about our Website users is among the assets transferred;

  • To comply with any court order, law or legal process, including responding to any government or regulatory request;

  • To enforce our rights arising from any contracts entered into between you and us, including our Candidate Terms of Service (www.amazetal.com/candidate-terms);

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, the Website’s users or others;

  • For any other purpose disclosed when the information is provided; and

  • For any other purpose with your consent.

We may share anonymized or de-identified information—such as traffic data (e.g., audience size and usage patterns) that we collect from cookies, web beacons or other embedded code—that is not tied to your Personal Information with third parties without restriction.

Other than as specifically provided, we do not disclose, sell or lease any Personal Information about you to any third parties.

Social Media Sites and Widgets

If you log onto the Website through Facebook or a similar social media site, certain information about you will be transferred to the Website, and the fact that you have logged onto the Website and some of that transferred information may be available to other users of the social media site. That information may be subject to the privacy policies of any such social media site, and you should review those policies before using a social media site to log onto the Website. Any such transferred information will otherwise be subject to the terms of this Policy.

You may be able to use social media widgets such as the Facebook Like button on the Website. These widgets will collect your IP address and identify which page you are visiting on the Website, and make your preference information available to third parties. The information collected by such widgets is controlled by third party privacy policies.

Choices About How We Use and Disclose Your Information

You have certain choices regarding the Personal Information you provide to us:

If you disable or refuse cookies, some parts of the Website may then be inaccessible or not function properly.

  • If you no longer wish to receive promotional e-mails from us or e-mails with information about education or career development opportunities that may be of interest to you, you can opt-out of such communications by clicking on the “Unsubscribe” or “Updating your e-mail preferences” link in the most recent e-mail you received from us and follow the prompts that appear. This opt-out does not apply to any transactional e-mails you may receive from us (e.g., confirmation of registration, updates to this Privacy Policy, etc.).

  • By accessing your account page on the Website, you can adjust certain privacy settings with respect to your personal professional profile (for example, to choose not to be seen by certain Employers).

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our Website who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to support@amazetal.com. Please note that we do not currently make disclosures of Personal Information to third parties for marketing purposes.

Accessing and Correcting Your Information

You can review and change your Personal Information and your credentials by logging into the Website and visiting your account profile page. You may also send us an e-mail at support@amazetal.com to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.

Children Under the Age of 18

Our Website is not intended for children under 18 years of age, and no one under age 18 may provide any information to this Website. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on this Website, make any purchases through this Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. Users Outside of the United States

Our Website is hosted in the United States and our services are provided from the United States. It is possible that certain information will be stored on servers in multiple other countries on the “cloud” or other similar distributed hosting platforms. If you are a user accessing our Website or services from the European Union, Asia or any other region with laws governing personal data collection, use, and disclosure that differ from United States laws, please note that you are transferring your Personal Information outside your home jurisdiction, and that by providing your Personal Information you are consenting to the transfer of your Personal Information to the United States and other jurisdictions as indicated above, and to our use and disclosure of your Personal Information in accordance with this policy.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information that you provide to us is stored on our servers behind firewalls and certain Personal Information will be encrypted using secure socket layer (SSL) technology.

The safety and security of your information also depends on you. When we have given you (or when you have chosen) a password for access to certain parts of our Website, you are responsible for keeping that password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website such as your personal professional profile. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information over the Internet is not completely secure. Although we have implemented security measures that we think are adequate, we cannot guarantee the security of your Personal Information transmitted to our Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Changes to Our Privacy Policy

We post any changes we make to our Candidate Privacy Policy on this page. If we make material changes to how we treat our users’ Personal Information, we will notify you by e-mail to the primary e-mail address specified in your account and/or through a notice on the Website home page. At Registration.  When you first register for the Website, fill out our registration form, and complete your Employer profile, we collect several types of information from you, including: your first and last name; contact information such as your e-mail address; Employer name and business telephone number; a web address for your webpage or social media pages (if any); demographic information such as office size, industry and years in business; a geographic location (city and state); information about your workplace environment such as what types of employee benefits you offer to employees; and (as an option) a photo of your business and/or logo for use on your Employer profile.

If You Post a Job Opening.  When you create a job listing to be posted on the Website’s job board, we collect several types of information from you, including information such as the position’s expected starting salary, any particular credentials or application materials you will require of applicants, and a job description for such job opening.  We will attempt to obtain your final approval of the appearance and details of a job listing prior to posting.

Additional Diligence.  With your permission, we may also work with you directly to obtain video interviews with your present employees and pictures of your workplace, or to conduct other additional diligence regarding your workplace and any job openings you post in order to provide interested Candidates with more complete information about you and your job opening.  We will contact you in advance of collecting such information and will seek your permission to conduct such additional diligence and share the results thereof on the Website.  Any such additional diligence may be conducted directly by Amazetal, Inc. staff, by your own employees, or some combination of the two.  

User Contributions.  You also may provide information to be posted, published or displayed on public areas of the Website (such as your personal professional profile), including information about yourself and other comments (collectively, “User Contributions”).  Your User Contributions, including any Personal Information you include within your User Contributions, are posted on and transmitted to others at your own risk.  We cannot control the actions of other users of the Website with whom you may choose to share your User Contributions.  Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.

Children Under the Age of 18

If You Offer Career Advice Consulting Sessions.  Through the Website, you may elect to offer one-on-one consulting services to Candidates.  If you choose to offer any consulting services, we will collect certain payment information from you in order to process payment by the Candidates of your consulting fees.

If You Review and Assess Candidates in the “Spotlight” Program.  Through the Website, you may elect to review and assess Candidates participating in the “Spotlight” program, which such assessments may be viewed by Employers considering hiring such Candidates.  Such assessments, which may contain a video response component or a text-only component, may include certain of your Personal Information if you choose to include it in such assessments, which such information will be shared with and may be viewed by participating Employers.  You will be permitted to set certain privacy settings to control the disclosure of certain of your Personal Information (such as your contact information or your present employer) to such Employers.

User Contributions.  You also may provide information to be posted, published or displayed on public areas of the Website (such as your personal professional profile), including information about yourself, feedback on interactions with Candidates, and other comments (collectively, “User Contributions”).  Your User Contributions, including any Personal Information you include within your User Contributions, are posted on and transmitted to others at your own risk.  We cannot control the actions of other users of the Website with whom you may choose to share your User Contributions.  Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

  • Share your User Contributions with other users at your direction;

  • Include your User Contributions in user ratings (e.g., ratings and reviews of Candidates you conduct for Employers) for other users to see;
